Terms of Service
Introduction
Welcome to PokerInk, a service provided by Accelra Technologies Inc.. References to "PokerInk", "we", "us", or "our" in these Terms refer to Accelra Technologies Inc.. By accessing or using our website at https://pokerink.com, you agree to be bound by these Terms of Service.
If you disagree with any part of the Terms, you may not access the Service.
Eligibility
You must be at least 18 years old - or the age of majority in your jurisdiction if it is higher - to create an account or use PokerInk. PokerInk contains poker and simulated-gambling themes and is intended for adults. By using the Service, you represent and warrant that you meet this age requirement.
PokerInk is not directed to children, and we do not knowingly permit anyone under the required age to use it. If we learn that an account belongs to someone who does not meet the age requirement, we may suspend or remove it.
Communications
We may send you service-related communications that are necessary to operate your account - for example, security alerts, transactional confirmations, and important notices about the Service. These are part of using PokerInk and cannot be opted out of while you hold an account.
We may also send product updates and promotional materials. You can opt out of these at any time by following the unsubscribe link in any such email or by adjusting your notification settings.
Accounts
When you create an account with us, you guarantee that the information you provide is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account.
You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for any activities or actions that occur under your account.
If you wish to close your account, you may do so by:
- Using the account deletion option in your profile settings
- Sending an email request to support@pokerink.com
Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of PokerInk and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without the prior written consent of PokerInk.
Subscriptions and Payments
PokerInk offers optional paid subscriptions that unlock additional features. Subscriptions are sold through the Apple App Store or Google Play, and billing is handled by the applicable app store - not by PokerInk directly.
- Payment is charged to your App Store or Google Play account upon confirmation of purchase.
- Subscriptions automatically renew at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; partial periods are not refunded.
- Refunds are handled by Apple or Google under their respective policies. PokerInk cannot directly issue refunds for purchases made through an app store.
We may change subscription pricing or the features included in a plan. Material changes will be communicated in advance and will not affect the period you have already paid for. If we increase the price of your subscription, we will notify you, and - where the App Store or Google Play requires it - the increase will not take effect until you consent; otherwise your subscription will not renew at the higher price.
User Data
You own all the data you provide to us. We only use it as described in our Privacy Policy. You can request deletion of your personal data at any time by contacting support@pokerink.com or using the account deletion option in your profile settings.
Third-Party Services
Our Service may contain links to third-party websites or services that are not owned or controlled by PokerInk. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
All third parties that access your information through our Service are required to keep your information confidential and use it only for authorized purposes.
User-Generated Content & Community Standards
PokerInkallows users to create and share content including hand histories, comments, messages, profile information, and other user-generated material ("Content"). By posting Content you represent that you have the right to share it and that it complies with these Terms and our Community Guidelines.
License to operate the Service
You retain ownership of your Content. By posting Content, you grant PokerInk a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, adapt, reformat, publish, publicly display, and distribute that Content solely for the purpose of operating, providing, securing, and improving the Service - including displaying it to other users where you choose to share it, generating analytics, and providing AI features. This license ends when you delete the Content or your account, except (a) for Content you shared with other users who have not deleted it, and (b) to the extent we must retain copies for legal, safety, or backup purposes as described in our Privacy Policy.
Your responsibility
You are solely responsible for any Content you post. PokerInk does not pre-screen Content but reserves the right - without obligation - to review, edit, or remove any Content that violates these Terms or our Community Guidelines.
Zero-tolerance policy
Reporting and appeals
You may report Content that violates these Terms using the in-app Report action on any hand, comment, or profile, or by emailing safety@pokerink.com. We aim to review reports of objectionable content and take appropriate action within 24 hours. If you believe an enforcement action was taken in error, you may appeal by emailing the same address with the subject line "Enforcement Appeal". Appeals related to permanent bans for child-safety violations are not accepted.
By continuing to use PokerInk or posting any Content, you agree to these Terms and our Community Guidelines.
Child Safety
Any content or account found to involve child sexual abuse and exploitation (CSAE) will be:
- Removed from the platform immediately upon identification.
- Reported to the National Center for Missing & Exploited Children (NCMEC) CyberTipline, Cybertip.ca (Canada), and relevant law-enforcement authorities as required by the laws of Canada or any other applicable jurisdiction.
- Subject to permanent account ban with no right of appeal.
If you encounter content that endangers a child, report it immediately:
- Use the in-app Report action and select the "Child safety" category.
- Email safety@pokerink.com with the subject line "Child Safety Report".
Changes to Terms
We may modify these Terms at any time. We will notify you by:
- Updating the "Last Updated" date at the top
- Sending you an email notification for material changes
- Displaying a prominent notice on our Service
Your continued use of the Service after modifications constitutes your acceptance of the modified Terms.
Disclaimer of Warranties
PokerInkis provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. PokerInk does not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that any content - including AI-generated coaching, analysis, or training material - is accurate, complete, or reliable.
PokerInk is a poker training and analysis tool. AI-generated coaching and any strategy guidance are provided for informational and educational purposes only and do not guarantee any result. You are solely responsible for your own decisions, including any real-money play, which PokerInk does not host, facilitate, or process.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
Limitation of Liability
In no event shall PokerInk, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
To the maximum extent permitted by applicable law, the total aggregate liability of PokerInk arising out of or relating to these Terms or the Service will not exceed the greater of (a) the total amount you paid PokerInk for the Service in the twelve months before the event giving rise to the liability, or (b) CAD $100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law - including liability for gross negligence, willful misconduct, or rights you may have under mandatory consumer-protection laws of your jurisdiction.
Indemnification
You agree to indemnify, defend, and hold harmless PokerInk and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses - including reasonable legal fees - arising out of or in any way connected with: (a) your access to or use of the Service; (b) Content you post or share; (c) your violation of these Terms or our Community Guidelines; or (d) your violation of any rights of a third party.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law provisions. Subject to applicable local consumer-protection law, you agree to submit to the exclusive jurisdiction of the courts located in British Columbia, Canada, for the resolution of any dispute arising out of these Terms or the Service. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
Termination
PokerInk may suspend or terminate your access to the Service, in whole or in part, at any time and without prior notice if you breach these Terms or our Community Guidelines, or where reasonably necessary to protect the Service, other users, or to comply with law. You may stop using the Service and close your account at any time as described above.
Provisions that by their nature should survive termination - including the license you grant to operate the Service (for Content shared with others), Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law - survive termination of these Terms.
General
- Entire agreement: These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and PokerInk regarding the Service.
- Severability: If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect.
- Assignment: You may not assign these Terms without our prior written consent. PokerInk may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Force majeure: PokerInk is not liable for any failure or delay in performance caused by events beyond its reasonable control.
California Residents (CCPA)
If you are a California resident, the California Consumer Privacy Act (CCPA) provides you with specific rights regarding your personal information, including:
- Right to Know: Request information about our collection and use of your personal information
- Right to Delete: Request deletion of your personal information
- Right to Opt-Out: We do not sell personal information
- Non-Discrimination: We will not discriminate against you for exercising your rights
